These arrangements also cover expatriates, that is, the expatriate must be paid at least the minimum wage under the relevant Austrian collective labor agreement.

Posted employees must be reimbursed for travel, lodging and meals in accordance with Austrian regulations and collective bargaining agreements. If the posting employer provides housing for employees, it must meet certain minimum standards, such as access to natural light, kitchen facilities, adequate heating, etc.

Working hours and vacation time

Even for short-term secondments to Austria, it is necessary to comply with Austrian working time regulations, which include laws, regulations and collective bargaining agreements, as well as occupational health and safety. If the secondment exceeds 12 months, all Austrian labor law applies, provided that it is more favorable to the employee than the law of the country from which the secondment to Austria takes place. As for the purposes of a possible audit of the regularity of the posting, the relevant documents must be kept in order to allow access to them by Austrian inspection authorities.
