IMI notifications - posting in transport

IMI is the Internal Market Information Exchange System, providing a tool for secure, convenient and multilingual data exchange between public administrations of European Economic Area (EEA) member states and European Union institutions at national, regional and local levels. IMI was developed by the European Commission with the active support of Community members. Its operation is based on Regulation (EU) No. 1024/2012. It aims to facilitate and strengthen administrative cooperation and provide mutual assistance. These activities are expected to have a positive impact on improving the functioning of the common market.

In February 2022, in terms of IMI, the rules for posting drivers for international transport changed. The form of declaration to all European Union Member States has changed. Consequently, new rules for the submission of documents in case of inspections were introduced. In addition, the obligation to have a representative was abolished.

IMI expanded with driver posting module

As of February 2, 2022, as a result of the introduction of the Mobility Package, all European Union member states are using a single common platform for notifications, namely the IMI system expanded to include a driver posting module. Importantly, it will also be implemented in those countries for which no such procedure was previously required. Examples of such countries are Czech Republic and the United Kingdom.

Transport companies are obliged to submit an adequate declaration through a special portal in case the drivers they employ are seconded to another EU member state to fulfill a transport contract. Regardless of the member state in which this driver will perform his duties, the format of the declaration will be identical.

Rules for notification in IMI of the posting of drivers

Using the IMI system involves activating an account, assigned to a specific person, with the possibility for that person to add other users. When setting up an account, you need to provide all the necessary information, such as the name of the company, its headquarters, license number and VAT number, contact details of the person responsible for the application, details of the contract, vehicle, driver and the type of transport he performs.

The information entered by the carrier will be automatically translated into the official language of the country to which the employee is posted, facilitating the actions of the inspection authorities. It will be possible to manually enter the required information or import it, which will significantly speed up the entire process.

Deadline and validity of IMI notification

The need to notify posted drivers in IMI applies at the latest from the start of the posting. The procedure will apply only to those to whom the Mobility Package's posting provisions apply, including those performing cabotage and cross-trade operations, excluding bilateral and transit operations.

Each country will require a separate
The validity of the notification will be from 1 day to 6 months and will be temporary, not dependent on the transport operation.
