Italy, by decree of the Italian Ministry of Labor and Social Policy No. 170 of Aug. 6, 2021, introduced new obligations for companies posting workers in its territory. Provisions on justifying the notification of a long-term posting have also been introduced. These changes have significant implications for Polish companies planning to delegate employees to Italy. Understanding the current requirements is essential to ensure compliance with local regulations and avoid potential legal problems.

New duties and requirements for posting to Italy

The party required to carry out this procedure is a company that sends its employees to provide services in the territory of another member country, either at the headquarters of another company or at its organizational unit outside the country, for example, at a foreign branch of the posting company. In order to make a notification, it is necessary to create a user profile on a dedicated portal. This profile is named and assigned to an individual. In the second step, the profile of the delegating company is assigned to him.

Delegation in Italy - what data are necessary to report?

In the notification of the employee of the delegation to Italy, the following information must be provided:

  • Identification data of the delegating company;
  • personal data of posted employees, including name, position, Polish tax identification number, date and place of birth, and nationality;
  • The start and end dates of the posting;
  • The location where the services will be provided;
  • specification of the type of services provided;
  • details of the company to which the employees are posted, including, for example, the date and place of birth of the president of the Italian entity and his personal tax identification number. Such information, unless provided by the service recipient, can be obtained from the company registry. The visura document, equivalent to an extract from the National Court Register, is available online for a fee.

Delegation of drivers in Italy

Italy has brought its regulations on the posting of drivers engaged in international road transport, or cabotage, into compliance with the EU directive through Legislative Decree No. 27 of February 23, 2023. The new regulations, enacted last March 20 with publication in the Italian Official Gazette, impose new obligations on businesses and sanctions for non-compliance.

According to Decree 67/2023, carriers posting drivers to Italy must submit a special declaration through the IMI system no later than the beginning of the posting to Italy. The declaration contains information about the transport company, driver, posting period, type of transportation and vehicles. If these details change, the company has five days to update them.

The new regulations also make it mandatory for the driver to carry on board not only a copy of the declaration, but also other documents pertaining to transport within the country, which must be presented during the inspection. In the case of cabotage, it is necessary to document that it was preceded by an international transport to Italy, as well as to present documentation for cabotage transports.

Failure to comply with the new regulations carries severe sanctions.
