Polish companies can legally post workers to Slovenia, as long as they comply with Directive 96/71/EC and local regulations. Key issues are:
- Notification of posting – you must notify the Slovenian labor office of the worker’s posting before starting work.
- Working time and wages – posted employees must be paid at least the minimum wage rates applicable in Slovenia. It is also necessary to comply with local regulations on working time, rest and vacation.
- Accommodation conditions – if the employer provides accommodation, it must meet certain quality and hygiene standards.
- Documentation – throughout the period of secondment, documents such as the employment contract, declaration of secondment, A1 certificate and confirmation of payment of wages must be kept at the workplace.
Posting of third-country nationals to Slovenia
Posting non-EU workers to Slovenia is possible, but requires additional formalities. The employee must have legal residence and work in Poland and meet the conditions under Slovenian migration law. It is often necessary to obtain a work permit or a temporary residence card in Slovenia.
