Posting employees to Slovakia - what should you know before working abroad?

Planning to send employees to work in Slovakia? It is worth ensuring that the entire process is carried out in accordance with the applicable regulations. Delegation to Slovakia is not only an organizational issue, but also a number of formal obligations, failure to comply with which may result in inspections or penalties.

Slovakia, as a member state of the European Union, has implemented EU directives on the provision of cross-border services. This means that the posting company must notify the employees to the relevant authority – in this case, the Slovak Labor Inspectorate – before they start work. The notification should contain detailed information about both the sending company and the workers themselves, the nature of their tasks and the expected time they will work in Slovakia.

One of the key documents in the posting process is the A1 form, which confirms that the employee is still subject to the social security system in his country. The absence of this document in the event of an inspection can mean serious consequences – both financial and administrative.

For people from third countries, i.e. outside the EU, the posting procedure is more complex. First of all, it is necessary to prove that the person is legally residing and working in the sending country and has valid residency documents. The employer must also make sure that it is possible to continue working in Slovakia without violating local immigration laws.

The situation is slightly different for the self-employed. To provide services in Slovakia, a self-employed person must prove that he or she has a viable and active business in his or her home country. It is also worth bearing in mind that Slovakia may require additional notifications or registrations in industry registers, especially for specialized services.

When posting to Slovakia, it is also important to ensure that the conditions of employment are no less favorable than those required by local law. This includes minimum wages, working hours, health and safety regulations or vacation rights.

The complexity of procedures can be overwhelming – that’s why it’s worth trusting a company that knows it inside out.
