Posting of workers to Latvia

Secondment of workers to Latvia is a process that allows companies from other European Union member states to temporarily provide services in the country. A key prerequisite for legal secondment is maintaining a genuine employment relationship with the sending country and meeting obligations under Latvian labor law and regulations on the employment of foreigners.

For posted workers, the legal basis is Directive 2014/67/EU as implemented into Latvian law. The posting employer must notify the employees to the relevant institutions in Latvia even before the work begins. It is also necessary to ensure that wages are paid in accordance with local minimum rates, that working and rest time standards are observed, and that adequate accommodation is provided if arranged by the employer.

In the case of the posting of third-country (non-EU) nationals, in addition to the standard posting notification requirements, it is necessary for workers to have a legal residence and employment title in the sending country. Latvian regulations require that such workers have been legally employed for at least three months prior to the posting. It should also be noted that in some cases additional permits will need to be obtained, such as in industries subject to special regulations.

Self-employed persons without employees who wish to provide services in Latvia are not subject to registration. In the event of a labor inspection, they must instead demonstrate that they are actually doing business in their home country and meet the requirements for entrepreneurs in Latvia. For non-EU self-employed individuals, the procedure can be more complex and require additional formalities.

Employers planning to post employees to Latvia should also remember the obligation to have an A1 certificate, which confirms that the employee is subject to the social security system in the sending country. The absence of this document can lead to administrative problems and the risk of double taxation.
