Posting of workers to Belgium
In Belgium, the EU Directive on the posting of workers in the framework of the provision of services and the Directive on the enforcement of Directive 97/71/EC and the prevention of abuse have already been implemented and are now being scrupulously monitored by Belgian labor authorities. Labor inspectorates check the compliance of workers’ accommodations and the observance of the requirements for terms and conditions of employment under generally accepted collective agreements. Businesses anticipating the posting of workers to Belgium should be aware of this fact and comply with the applicable regulations.
Rules for posting an employee to Belgium
When sending employees to work in Belgium, it is important to give special consideration to issues related to collective bargaining agreements, social security, and the Limos registration and attendance rules specific to the legal system there.
The basis for posting an employee to Belgium is the conclusion of a contract with a Belgian employer. It is worth noting that only registered and recognized employment agencies in Belgium are authorized to provide workers. For this reason, it is advisable to accurately describe the nature of the work to be performed during the posting period.
