Posting of workers to Portugal

Portugal, as a member of the European Union, allows legal posting of workers from other EU countries, including Poland. More and more companies are taking advantage of this opportunity, especially in the construction, industrial, service or tourism sectors. However, in order for the posting to be legal, certain conditions and Portuguese formalities must be met.

Posting of workers to Portugal - the most important information

The posting of workers to Portugal is subject to Directive 96/71/EC and Directive 2014/67/EU, as well as the Portuguese Labor Code (Código do Trabalho). In particular, employers must:

  • Declare the posting – a notification must be sent to the Portuguese General Labour Inspectorate before starting work
  • Designate a representative in Portugal – the delegating company is required to designate a contact person residing in Portugal who will be responsible for liaising with the Portuguese control authorities.
  • Ensure that working conditions comply with Portuguese law – this includes, in particular: wages (in accordance with the legal minimum wage or rates from collective bargaining agreements), working hours, vacations, health and safety, and equal treatment.
  • Keep records – throughout the posting period (and for at least 5 years afterwards), you must keep supporting documents: the employment contract, the A1 form, confirmation of ACT enrollment, and proofs of payment of wages and time records.

Posting of the self-employed to Portugal

Sole proprietors in Poland may provide services in Portugal under the principles of freedom to provide services in the EU. There is no obligation to register an activity in Portugal, provided that the services are temporary and cross-border in nature.

In some industries (e.g., construction, technical installations), there may be additional professional requirements or the need to report activities to local registries.
