Posting of workers to Greece
In modern business, various ways are being used to grow the company. One of them is to delegate employees to work abroad. This is an increasingly common method, influenced by growing international cooperation. However, it is important to remember that when sending employees to a foreign country, you must comply with both Polish law and the regulations in the other country. If you have encountered problems when posting employees to Greece, we can provide expert support. Thanks to many years of experience in this industry, we are able to provide expert advice on dealing with the formalities. We primarily work with companies operating in transportation, construction or welding and assembly of structures.
Delegation to Greece - basic principles
Posting workers to Greece, as with other countries, involves temporariness. This means that work abroad is performed for a specific period of time. Accordingly, there are two periods of posting – short-term and long-term. We deal with the former when the posting to Greece does not exceed 12 months, and the latter when the employee is sent back to work for more than a year. Another important thing is that the employer must provide the delegates with the same terms and conditions of employment that apply under the law or the collective agreements used. This applies in particular:
- minimum rest periods,
- maximum working time,
- salaries,
- Health and safety in the workplace,
- accommodation conditions,
- Equal treatment of men and women.
If these issues are more favorable to the employee in Poland than in Greece, then Polish working conditions are maintained during the entire period of the posting. It should also be added that an employer who has sent employees on a business trip to Greece, for up to 8 days during the year, is not required to comply with regulations related to pay and annual leave.
Posting of workers to Greece and social security and taxes
If the delegation of employees to Greece does not exceed 24 months, it is necessary to have an A1 certificate. This document is confirmation of being subject to a specific social security system. In our country, this certificate is issued by the Social Insurance Institution. An application for its receipt should be submitted before posting employees to work abroad. If the A1 certificate is missing, the country to which the employees have been posted may impose an obligation on them or the employer to pay contributions, as well as a penalty of 10,500 euros. However, it is worth noting that it is possible to cancel the penalty. To do so, it is necessary to retroactively obtain an A1 certificate.
When posting workers to Greece, you also need to familiarize yourself with tax regulations. In the mentioned country there are 4 tax rates: 22%, 29%, 37% i 45%. However, it is worth noting that Poland and Greece have signed a double taxation treaty on income and property taxes. What’s more, an employee is subject to taxation in Poland if he is a Polish tax resident, i.e. he has a center of personal or economic interests in the Republic of Poland or stays in our country for more than 183 days in a tax year.
