Brexit: Posting of British employees to France

In terms of Brexit and French labour law, the same rules will continue to apply as before. British businesses that use the SIPSI online service to submit their posting declaration will still be able to do so, the only change being that they will no longer be able to enter their intra-Community VAT number, and will have to enter their national registration (identification) number instead.

However, and especially in a Brexit no-deal situation, major changes are likely to affect other formalities applicable to posted workers: 

  • Regarding social security, employees might have to be declared to the French social security scheme (since the regulation on the coordination of social security systems will no longer apply),

  • Regarding work permits, these may need to be requested in addition to submitting a posting declaration, as is required for the other nationals of third countries
