Posting of workers to Lithuania

An expatriate employee in Lithuania is a person who works in another country, but has been temporarily sent to work in the territory of the Republic of Lithuania. In accordance with European Union legislation and national regulations, workers who have arrived in the country are entitled to adequate labor guarantees due to, among other things: prohibition of discrimination, health and hygiene standards, working conditions, remuneration, leave, working hours and rest [1].

The posting of workers to Lithuania must be done in accordance with a contract for the provision of services or work, concluded by the employer with a client operating in the Republic of Lithuania. The regulations also take into account work in a branch, representative office, company or other establishment of the employer, as well as work as a temporary employee [2].

Notification of posting of workers to Lithuania

An employer planning to post employees to work in Lithuania is obliged to provide information on this subject to the field branch of the State Labor Inspectorate. The notification should specify precisely the place of posting, its duration and the guarantees to which the posted person is entitled.

When a posting in Lithuania of more than 30 days is anticipated, the posting company is required to notify the State Labor Inspectorate in advance. The authority then conducts the necessary inspections to make sure that the posted persons are working legally and that the relevant regulations are being observed.

Delegation to Lithuania - drivers

In the case of cabotage and international transport the basic step, when it comes to the secondment of a driver in Lithuania, is to file a declaration of secondment of the employee before the employee starts his business trip.[3]

During the course of it, drivers should have the following documents:

  • A copy of the declaration of secondment (in electronic or paper form),
  • Proof of carriage on the territory of the host country (for example, a waybill)
  • tachograph records documenting drivers' working hours and breaks.

Inspection authorities have the right to ask the employer to show additional documents. Among them may be:

  • Salary slips and payment confirmations,
  • Tachograph records and time cards,
  • proof that the transport operation was carried out in the host country,
  • delegate's employment contract,
  • The conditions of her pay and work.
