The first step in the entire process is the registration of the company in the Italian Distacco system, which constitutes the basis for subsequent notifications of posted workers. This ensures that the employer operates in compliance with the law, avoids financial penalties, and provides employees with full protection under applicable regulations. In this article, we will explain the obligations that companies must fulfill, as well as the procedure for notifications and documentation related to posting.   <\/p>\n\n<h2 class=\"wp-block-heading\">Company Registration in the Italian Distacco System<\/h2>\n\n<p>Pierwszym etapem, kt\u00f3ry musi przej\u015b\u0107 ka\u017cdy zagraniczny pracodawca planuj\u0105cy legalne delegowanie pracownik\u00f3w, jest utworzenie profilu firmy w portalu Distacco (CLICLAVORO). Rejestracja firm we W\u0142oszech polega na utworzeniu konta przedsi\u0119biorstwa w systemie w\u0142oskiego Ministerstwa Pracy, gdzie podaje si\u0119 dane identyfikacyjne firmy \u2013 nazw\u0119, adres siedziby, numer NIP\/VAT oraz dane osoby reprezentuj\u0105cej. Dzi\u0119ki temu przedsi\u0119biorstwo uzyskuje dost\u0119p do platformy i mo\u017ce sk\u0142ada\u0107 obowi\u0105zkowe zg\u0142oszenia oddelegowania pracownik\u00f3w. To jednorazowa procedura, ale absolutnie niezb\u0119dna, poniewa\u017c bez niej nie ma mo\u017cliwo\u015bci dalszej obs\u0142ugi procesu delegowania na terenie W\u0142och.<\/p>\n\n<h2 class=\"wp-block-heading\">Posting Notification (Notifica di Distacco)<\/h2>\n\n<p>Po dokonaniu rejestracji w systemie Distacco kolejnym obowi\u0105zkiem pracodawcy jest z\u0142o\u017cenie zg\u0142oszenia oddelegowania, czyli tzw. Notifica di Distacco. Dokument ten nale\u017cy przes\u0142a\u0107 do w\u0142oskiego Ministerstwa Pracy najp\u00f3\u017aniej do p\u00f3\u0142nocy dnia poprzedzaj\u0105cego rozpocz\u0119cie pracy przez pracownika za granic\u0105. W formularzu trzeba poda\u0107 szczeg\u00f3\u0142owe informacje, takie jak dane firmy i delegowanych pracownik\u00f3w, miejsce oraz czas trwania oddelegowania, rodzaj wykonywanej pracy, a tak\u017ce dane osoby kontaktowej wyznaczonej we W\u0142oszech. Ka\u017cde oddelegowanie wymaga odr\u0119bnego zg\u0142oszenia, a w przypadku jakichkolwiek zmian np. przed\u0142u\u017cenia okresu pracy czy zmiany miejsca jej wykonywania, pracodawca ma obowi\u0105zek poinformowa\u0107 o tym w\u0142oskie instytucje w ci\u0105gu 5 dni. The employer must ensure the availability in Italy, either in paper or electronic form, of documents such as employment contracts, payslips, records of working hours, proof of payments, and A1 forms confirming coverage under the Polish social security system. Importantly, all documentation must be available in Italian in order to be presented during inspections by local authorities.
