Posting employees to work abroad always involves certain formalities. This is no different in the case of Hungary, which, as a member state of the European Union, requires posting companies to comply with regulations under national and EU law. <\/p>

To begin with, it is worth noting what posting actually is. We refer to it when an employer sends its employee to perform work on the territory of another
EU member state, in the course of providing services. While the employment remains the same, the responsibilities associated with the posting fall largely on the sending company. <\/p>

One of the most important documents that should accompany an employee to Hungary is the A1 certificate – confirming that he or she is still subject to the social security system in the sending country. This is an essential document for inspections, and its absence can lead to serious consequences, including the obligation to pay contributions in Hungary. <\/p>

Before the start of the work, the company must report the posting to the Hungarian office via an electronic platform. The notification must include, among other things, the employer’s data, the employee’s data, the place of work and the expected duration of the posting. It should also be remembered that a contact person must be available at the company throughout the period of the work assignment to cooperate with the Hungarian supervisory authorities. <\/p>

Additional requirements apply to the posting of third-country nationals – from outside the EU. First of all, they must have legal residency and employment in the sending country, and the employer is obliged to make sure that the conditions are met for them to work in Hungary. In some cases, it may be necessary to obtain additional documents confirming compliance with immigration regulations. <\/p>

Self-employed individuals who plan to provide services in Hungary must also document actual activity in their home country and be prepared to demonstrate that there is no employment relationship with the recipient of the services. Some industries may also have additional registration requirements. <\/p>

It is also worth bearing in mind the so-called minimum conditions of employment, i.e. the need to provide employees with wages and working conditions that comply with Hungarian law. This includes issues such as minimum hourly wages, working time limits, breaks or health and safety protection. <\/p>
